DEMONSTRATE PATENT INFRINGEMENT USING CLAIM CHARTS

Claim charts sit at the crossroads of legal and technical fields and involve a careful interpretation of each claim of a patent side-by-side with technical arguments showing an accused device's use of a patented technology. 

Providing hard evidence of each limitation in a claim involves a technical investigation.  Sometimes it requires complex reverse engineering.  Other times, evidence can be shown with easier and more creative analytical techniques.  The goal is to find the most economical approach that offers bulletproof technical arguments.

In the early 1990's, TAEUS pioneered the color-coded claim chart illustrating each element of a claim in the targeted device in an easy-to-understand presentation.  Today this is an industry standard.

How claim charts work:

The claims are parsed into several rows in the first column highlighting each limitation in the claims of interest.  The second column contains the subject matter experts' and legal team's interpretation of each limitation in the claim.  In the third column, the interpretation is documented by referring to text and figures in the patent to demonstrate that the interpretation is accurate.  In the event that there is a Markman ruling, that interpretation is used, however many technical investigations precede or often supersede litigation.  The final column contains the infringement analysis and demonstrates each claim limitation and where it can be found in the accused device.
