Who buys patents and why do they buy them? Knowing your prospects and understanding their buying motivations is paramount to any licensing or sales campaign.

Why companies buy patents:
  1. They read on a competitor's products. If we can show this, your patent is as good as sold.
  2. Defensive purchasing. If your patent can be used in a cross licensing campaign by a manufacture, it will find a new home.
  3. Entering new markets. Companies looking to expand into new markets buy patents to shore up their portfolios, and keep competitors at bay.
  4. Freedom to operate. When new products are developed, companies perform extensive technology clearance studies to make sure they are not infringing on anybody else's technology. The clearance strategy involves a combination of licensing, purchasing and designing around others' patents.
  5. Non Practicing Entities, Product Licensing Enforcement Companies, Trolls & IP Investment Firms: Since 2000, this broad market segment has expanded faster than any other. There is extreme competition among these firms for valuable patents.
  6. Next big thing? Not as much. If your technology is early stage, and has not been adopted by the industry or by a standards-setting body, adoption risk of the technology can lower the value. We will recommend strategies to bring value to emerging technologies.
  7. Product Hedging. Even if your technology has not been adopted, a strong case can bring value to your IP. IP buyers must protect future products as well as current product lines. Nobody has a perfect crystal ball, so resources are routinely allocated for technologies with potential future applications.

Why sell your patents:

  1. Increase cash flow today.  When the deal closes, and title changes hands, you get a check.
  2. Maintain right to practice invention.  Selling your patent may not impact your ability to practice your invention.
  3. IP enforcement by proxy.  Bring well-funded and skilled licensing enforcement professional to your team.
  4. Lower costs than your competition.  They have to take a license, you don't.  A significant cost advantage to you.
  5. You are no longer practicing the invention.  The patent may no longer be valuable to you, but may be to the right buyer if positioned correctly.  Why not put the technology to work?  What's the alternative?
  6. Helps build the market for your invention.  In the hands of a large manufacturer or large IP licensing firm, the likelihood of your invention becoming a de facto standard is much greater.  You can maintain your competitive lead since you developed the technology and have a lower cost structure.

In the high tech sector, there are a couple hundred corporations worldwide who routinely write checks for patents and technologies. We know them, and we know to position your patent to get their attention.
