PATENT EVALUATION SERVICES: TAEUSWORKS

Before an IP executive can make key decisions on licensing, sales, enforcement or portfolio management, it is critical that they have a good understanding of the strengths and weaknesses of each patent.
 
We have made the patent evaluation process more consistent by applying an evaluation framework that subject matter experts (SMEs) use to provide their opinion on a patented technology.  The framework is called TAEUSworks, and is the result of our experience evaluating over 50,000 patents since 1992.

TAEUSworks is not a software algorithm
 
TAEUSworks is a human-based process where multiple subject matter experts (SMEs) score and rate a patent from one (1) to five (5) for each of the following eight criteria.
 
  1. Observability
  2. Ease of Investigation
  3. Lack of Prior Art
  4. Alternatives
  5. Technology Maturity
  6. Current Commercial Use
  7. Future Commercial Use
  8. Strength of Claims
 
Each of the criteria above has its own set of specific definitions of what it means to be a one vs. a two and so on.
 
To ensure consistency and accuracy SMEs are trained to rate patents within the TAEUSWorks system.  The patent evaluations are then moderated by a TAEUSworks Program Manager. The moderator requires that each SME to justifies and documents their ratings and opinions. After some discussion and debate, a single number is developed for each of the eight rating criteria, and specific language is created by the team to substantiate the rating. The result of this patent evaluation process is a patent-centric rating of the quality of the patent from a technical perspective, an understanding of the reasons for this rating, and a list of potential licensees (companies and products) for the patent.
